So heres the damage..

I looked at the car more last night.... I couldnt wait. Everything looks good....which is making me nervous that I'm missing something. The wheel is still centered, nothing is binding or appears bent, the balljoints seem fine etc etc. I'm just really suprised I could have done that much damage to the rim without tweaking something else. Since there is no body damage I must have just clipper the rim/tire with the outside edge of my rim. My rim would have been turned to the pass side alot, so I'm thinking the force would have been back and up, towards the outside of the car, rather than pushing in towards the frame etc As for the point etc....yes I plan on doing more research before I let this all go. I have the guys name, the tow truck driver and CHP names etc etc to. A good friend of mine is a lawyer and he wants to jump all over this to make sure this guys pays for it. If he's all fired up to run with it, I may let him and see how it plays out....worth a shot ot get the rim and tire paid for. As for insurance....mine is Grundy and its the only car I have on there. I'm gonna call and get some info before I decide about a claim or not. The rim seems to list for around $600....tire $200.....mounting say $40..alignment etc of around $100...so if all else is well, I'm looking at around $1k in damage.... Not "break the bank" but not cheap either..... |
Did CHP write you a ticket? If so, what the heck for? That is the only way to get points put on your driving record isn't it? I am not an officer, nor do I know all of the laws, but this sounds absurd ! If you did get written, your lawyer should have no trouble getting a judge to overturn it. I am sorry to hear about the damage, but as you stated, it could have been worse, especially if your boy was with you... The vehicle can be fixed.

Man that sucks. Have you looked into having the wheel repaired there are some companies that do just that. Wheelamerica I think is one where in TX. Also I don't know it's not that guys fault. Espically since he did not have INS he should have been cited on the spot. I am pretty sure you can take him to court. Hope it works out for ya.

That's horrible.
I can't fathom the way the CHP handled the situation. "It was stationary" they said. Last time I knew, other people's tires/rims were not part of the public highway. Doesn't seem right. Good luck to you and at least you & your boy were not injured.:lateral: |
No CHP didnt give me a ticket... he basically said if I file an accident report for hitting a stationary object, it gives me a point on my record.
The other driver apparently owns a body shop so he has insurance for any vehicle he uses through his business...of course the CHP never verified this claim...then never even called in his license or reg etc, so for all they know this guy could be a wanted felon. So the moral of the story is if any of you guys want to dump stuff all over the freeway for people to run into, youre free and clear of any responsibility if someone gets injured.:thumbsup: |

damn ned that f-in sux but THANK GOD the rest of the cars ok. the whole situation really pisses me off though. typical crap, they ticket ya for smoke out of the tail pipes but its cool to have a cars wheel fall off and not have insurance...
i hit a median going 50 before in my forth gen and destroyed my rims too, both front and rear. but there was absolutly NO damage any where else ,I coulnd believe it either. |

i hit a chunk of cement on the hwy at 100km/hr and did more damage to my aluminum wheel..it was literally missing chunks of aluminum...i thought it be replaced but it was fixed for under 200bucks...so id look up some wheel repair shops in your area and take it in for a estimate

That sucks Ned....much cheaper than bending sheetmetal though.
Here in Oregon it would be the same as far as not being other driver's fault for the tire. The expectation is that you should be able to stop before hitting an object in the road....BS I know. Ultimately I think it limits the states liability for potholes and bad roads which can damage tires/wheels as well -Rob |
