I guess I can't type the word "Xustang" anymore..
Ford stock is in the toilet.. the companies image is hurting so what do you do? Sick you lawyers on companies that use the words "Mustang" "pony" or "stang" in any way whatsoever..

Well... it's not the first time something like this has happened. GM did the same thing with all the Corvette shops, etc. They own the name. Any intelligent business owner should know not to call their company "Corvette Mike's" or something like that. The gas station named "Mustang Mart" could argue that they are referring to the type of horse, not the car if they are in an area indigenous to the animal... Afterall, what is Ford going to do - make us change the namesake animals' name because they trademarked it? Sue American Indians for riding their Mustang horses? Maybe Turtle Wax should sue to make us all stop calling the little hard shelled critters by their actual name and come up with something else...
Like anything else, what is required here is "common sense". Unfortunately, maybe someone already trademarked that phrase so we can't use it anymore. :willy: |

At least the word "Corvette" was coined by GM.. Ford couldn't even be that inventive ;) And does this really help Ford in the long term (or Corvette for that matter) to piss on companies and websites that help your fan base? |
Take a look at the back of a Harley Davidson catalog. They have copyrighted nearly every word you can think of that even remotely relates to Harleys.
They have even copyrighted the sound a Harley makes so companies can't even use a recording of a Harley in a radio or TV ad. I'm actually suprised that Ford waited as long as they have to do it. Good decision. |

Dosen't seem to have hurt Harley. They made their move right after the AMF debacle when they were at their lowest point. It's been all good for them since.
Correlation is of course not causation, but the move hasn't hurt them at all. Some would argue that it provided the Harley aftermarket a better means of creating their own brand identity for their products rather than having everyone co-opt the Harley names which gave a sense of sameness to everyones stuff. |
corvette
Actually GM did not coin the phrase/name "Corvette." Corvette was a very fast warship in the 1400's or 1700's. I cannot remember the exact date.
Here is an idea for all of the people the have Mustang shops. Have your name legally changed to Mustang. Then the company is named after you and not the car. IE Steven Mustang Rupp. |
I wonder...
I wonder if you could call your company "The Parts Place Formerly Known As Mustangs Unlimited...."
That's not technically using Mustang in the name, is it? :unibrow: |

I thought it was a class of Battleships in WWII? |
This happens all over the place, anyone see how many places Monster Cable has sued for the term monster? They have sued (and won a bunch) everyone you can think of....you'd swear it was the owners mission in life.

Oh.. I almost forgot
Ford Motor Company F 6.90 -0.05 (-0.72%) Maybe Ford shoud be fixing thier screwed up business rather than going after companies and enthusiasts that are NOT the core problems at thier company.. |
I posted this on the Pro Touring board...
Does this mean all of these still flying will have to be renamed? So maybe Ford should be sued by North American for trademark infringement... Too bad NA went out of business... http://upload.wikimedia.org/wikipedi...50px-P-51D.jpg Maybe http://www.blm.gov/ needs to sue Ford... Will they have to change the name of these? http://www.ansi.okstate.edu/breeds/h...g/mustang4.jpg Will Wilson Pickett have to rename his song? AND change the words in it? Mustang Sally Originally performed by Wilson Pickett Hit # 23 on the Top 40 charts in 1966 Remade by The Commitments for the movie "The Commitments" in 1991 Mustang Sally, Guess you better slow your Mustang down. Mustang Sally, my baby, Guess you better slow your Mustang down. You been a runnin' all over the town now, Guess I'll have to put your flat feet on the ground. "The intent is to eliminate the use of trademark names, including Mustang and Thunderbird..."
So many businesses will be impacted...just the Thunderbird stuff alone should keep the lawyers busy for a decade... I hope that American Indians are able to get some restitution...after all, they came up with it in the first place, right?? |

They aren't going to come after a message board like this one unless it somehow is damaging to the image of the brand. It poses no relationship confusion threat, nobody is making any (real) money off of it, and unless it is a site dedicated to images of gay midget sex on the hood of '67 mustangs it presents no damage to the brand image. But, if www.StevenRupp'sHouse-O-Mustangs.com which sells parts over the net also has a message board he might get a cease and desist order. Harley has never come down on a club, and I sincerely doubt Ford will either. |
corvette
I did not "google it" but a corvette was a class of sailing ships from Spain I believe. They may have used it in WWII since it was a successful ship in the days of wind power.
|
Shelby is doing the same thing but also on parts, name branding, emblems, fiberglass parts, ect. It's the new trend. :thmbsdwn:
|
Not new at all actually.

The protection still provides HD with the means of coming down on someone for using the sound of a Harley in a fasion that implies endorsement. Progressive Insurance got whacked for using it in radio ads about 7 years ago. |
