If that is the case, it sounds to me there is some funny business going on there and they think they can make a good amount on your car.

If they are running it back through and you get the cash, that is a different story.

I have never heard of a car not passing and the state not giving you the opportunity to fix the problem and re-test.
Agreed,if BJ's paying you the $85k and then re-selling in Scottsdale, something does sound fishy to me too.

sounds to me that they're confident they can sell it for more at that event.

Sounds to me like BJ is "doing the right thing" -- for a buyer that is no doubt a "good customer" -- and who also has some clout.... AND that they also don't need either the seller or the buyer "lawyering up"...

So let's consider that - they got a fee for registering - and the seller fees of 8% come out of the 85K -- and they probably made some kind of a deal with the buyer... ($$ to buy his way out of taking the car)... so they're not in the car 85K are they.... If they can RESELL the car for 85K even -- and collect another 8% buyer fee....

Let's see anyone out there that can give me 8% return on my money for a 6 month term.

We know they don't have to do diddly to the car - wipe it off and it's ready to go. Pretty safe "bet" I think... and they keep everyone happy... including their CFO.

To those that think BJ is doing something "funny"....

Think about this... if they don't go thru with paying Frank for his car... since they dropped the hammer on it... Frank did what he was supposed to do... And they try to get Frank to take the car back.... I'd say Frank would be pretty PO'd... OR...

If FRANK wanted to take the car back... then take on the risk that he gets his transportation (or storage) charges - plus his fees - and expenses - and is able to sell it for MORE (now that he's out of pocket more for all of this) at Scottsdale...

If I'm Frank and was happy or "okay" with the Vegas sale - then he's a happy man - and it's a very small risk for BJ just to make the deal go away. 85K might seem to be a huge number for some -- but I'm thinking that's VERY VERY small potatoes for the BJ folks... VERY small. That - and they may even have a customer that wanted the car and just didn't bid - and that car might already be "gone" to someone. They know LOTS of car people... it ain't hard to make it go away.

So who officially owns Emptynest now? BJ , the buyer or Frank? And who got what and who paid who what? I am TOTALLY confused by how it all went down. If in fact Nevada will not let anyone tune the car to pass smog that alone sounds really odd to me.

From what I'm reading BJ owns the car - is paying Frank - and Frank is hoping to get a promo tour special to do a song and dance routine for the car at Scottsdale...
