The fluid needs to be checked at operating temp while the car is running. If it has been more than 30,000 miles I would change the filter.

Thats exactly what I was going to say. Its very common for the rear seal to even leak in the winter because of the cold. I just went thru this with my truck. Put it in gear, nothing. Checked the fluid. It was low and it fixed the problem.
Probably not the filter.
