Greg,

Yea, I know. I'm not that green but in this case as you say they are big enough to handle filling some orders. It has been my experience that the squeaky wheel gets the oil. It is appropriate to file a BBB report and if my cousin can give me some key buzz words to hit some supervisor with maybe I can persuade them to follow through. If not, I am more than satisfied to just make them squirm a bit. I guess that's what I would say to all here. Make it be a pain for them. They deserve it. we'll see what happens. I definitely am not going to loose sleep over it. Later Buddy, I have 20-7 year old girls coming to the house for a birthday party today! Woo Hoo

A better analogy would be someone you didn't know offered to sell you their house for about 1/2 the appraised value (after all the welders aren't $1.00 they are at a steep discount). Then after you actually closed on the house and you gave them their money they think twice and want to back out.

In this particular case its hard for them to simply claim a pricing error because two models were specifically marked as "On Sale", they weren't just a $1.00 or $5.00 but offered at heavy discount. And they processed the sale by charging credit cards and sent confirmation emails, so its not so simple.

Let's say you told your best buddy you'd sell him your house for a buck -- and he says "done - I'll take it".... a jury - should he decided to sue you for reneging on your contract - would find in your favor as the deal was surely too good to be true and he should have known that.

If you read the thread - there are many "questioning" the price and the fact that it might be too good to be true right from the get go...
My argument would be that it wasn't "too good to be true".. or even unheard of.. 50% off is not an unheard of discount. Now if it was $4.99 then a reasonable person would know that was a typo.. Toss in that TWO units were priced like that and I would think you would have a case.

Of course I'm not a lawyer.. but I did stay at a Holiday Inn Express once..

Good one Steve!

Of course here's the age old issue that everyone runs into when it comes to these things...

Were you somehow "damaged"? So an attorney gets $300 an hour - it takes them an hour to write a letter.... Their attorney laughs and responds with a polite -- F U! Strong letter to follow! Because their attorney knows you were not damaged and the worst they would have to do is to honor the sale -- in the meantime you could have paid full retail and it would have been cheaper. It's why this stuff goes nowhere... fun to talk about - but in reality - it goes nowhere.

You would hope that they'd want to save face - and honor the transactions - but then again......

I call BS on Grainger. I spoke with no less than 5 different people and they all gave me different reasons why they couldn't fill the order.

1.They sold all that was in stock so no more orders would be filled.
2.The machine is not CA legal.
3.There was a pricing error.
4.Miller no longer makes the machine.
5.Acted like they had no clue about the ad after being on hold but not before I was told my order was canceled because the part # didn't exist before being put on hold.
6.Told orders could not be processed because the machine wasn't CA compliant but Miller will be sending them CA compliant machines for orders processed for CA customers.

Just a lot of lies and BS from Grainger. I will save my money for the small shops and never deal with them again.

i still havent heard anything, and thats the biggest bs of all. out of all the stories theyre giving out, i believe the "it was only meant to be a few and the system didnt catch it when they were gone".

although i wasnt sure it was totally legit, i wasnt positive etiher way. check the clearance section of their site. they list 641 pages of products at a discount, some more than 70% off. there were a few electric motors marked down over 50% and that was a $1,000 discount. not unheard of if they are trying to clearance stock.

Somehow we gotta figure out what's behind this "regulatory restriction." I understand mistakes happen. However, making up excuses is unacceptable for a business. A simple "we made a pricing error and apologize. here is a coupon for your trouble" type response would have been much more acceptable. I'd think they are likely to run into many more issues with their current approach to handle this mistake THEY made.

Their excuse about not being legal in CA is true and BS at the same time. I spoke with a Miller rep and he stated that, yes there is a non-compliant CA model due to lead being used on some parts but that they also have a CA compliant machine of the same model. There shouldn't be ANY problems filling the orders. They just choose not to and hope customers will accept that excuse.
