The no retest sounds wrong. Say I'm the buyer and pissed, I want my car. Now what?

Or, and maybe I missed this, I'm an out of state buyer, and my state lets me drive the dirtiest rotton pig my heart desires now what?

BJ offered me the car back if I agreed to take it to Scottsdale with a Prime Time number. They would cover the shipping, secured storage, all expenses, but wanted me to re run it at Scottsdale. I do not want to do that. I am slightly concerned that it could become "that car" and suddenly does not bring the money because it already sold at Vegas. According to BJ, they CANNOT release the car without a clean emmisions certificate, period. There is no I will take and get it cleaned up option. And the buyer and I talked and he was not willing to chance it passing emmisions later. And he was REALLY affraid of buying a certificate as I understand this could be a huge problem. And with a car that is red flagged already!

On the other side of it, if you watched the auction, it was obvious BJ thinks the car sold for half price, so for them why the hell not take a chance I do know for a fact they were smitten with the car.

Greg is dead on, if I can go sit with it again as the builder and get the promo tour out of it, and get my money, PERFECT!

I know, I know, what if it sells for $250K? No I won't kill myself! I will tell everyoone, see........It was worth more money, LOL! And then for life tell the story of the car I sold for $78K that brought $200K.

So is B-J obligated to buy back every auctioned vehicle that fails a Nevada emissions test?

I just read about the troubles at BJ-Vegas.....sorry that you guys had to go through all of that, but it looks like BJ is taking care of you and the buyer by letting him opt out...so that is cool.

At first when I read over on another forum that there was a mix up and that the car ended up not being sold, I was like....

what?!!!!! I was thinking it might have been over the left tail light not working at the time of sale or something silly like that.

I do not think BJ is obligated to do anything. I think they are doing what is best for everyone involved. The buyer was pretty clear he did not want any emissions headaches. Maybe someone in Vegas can shed some light, but I understand it is a real PIA.

As for the taillight not working, someone knocked the bulb sockets out (or broke the bulbs sockets out) of that side installing the trunk trim panel when disconnectiong and reconnecting the battery. No big deal. But you would think it fricken threw a rod on stage the way some have talked about that damn taillight, LOL! I'll never let that happen again!

Is this emissions issue only related to the Vegas auctions or others as well? Is BG auctions based out of Vegas? Technically dont the consigners sell it to BG prior to the auction persee.

Don't know exactly what happened. It seems there may need to be a disclaimer is sold in Nevada to neveda resident? Only guessing though, I really do not pretend to understand.

Ask me about the 42' Grand Banks I bought in 1990 and paid cash for - because I'm a debt adverse kinda guy - and I sold MSFT stock to do that - figure that boat cost me around 20 million. (not kidding here) -- or the House I bought in 1987 (again paid cash) with our very first MSFT stock option sale which I think would be around 30 million worth of stock at the peak in 1999.

Today - my wife and I laugh at those "transactions" but we don't regret them one bit.

Raised my kids cruising on that boat... put lots of happy hours on her... and ditto the house - which by the way -- was my HOME not an "investment".... it's where we lived and played and had many great meals...

Some of my friends that built MONSTER homes - margined the stock and carried the debt (spelled MILLIONS) on their houses waiting for the next stock split... YEP -- you guessed it... they all made fun of me for being a dumbass sissy... But they're broke now.... cause they owed on the house - owed on the margin - owed taxes when the margin was called - and the stock never split again and sunk by 50%... Now who's laughing?

Woulda/Shoulda/Coulda? Not me buddy - not me... Car was sold for a number that made you happy - Bring down the gavel! SOLD IT SOLD IT SOLD IT... Movin' on.

I don't know the "rules" about Nevada sales - but I do know that SILVER AUCTIONS mentions the smog rule several times during their auction at RENO...

They say something like - "this car is not for sale to a NEVADA RESIDENT so unless you are a dealer Do NOT bid on this car. This car did not (or will not) pass emissions"

Going from memory here on the wording - but I have heard it enough that I am pretty dang close! I've NEVER heard BJ auctioneers state this though... so no wonder they got "in trouble" here!
