If he's somewhat "guilty" of trying to buzz the guy -- and he knows whether he did or not - he'll retire... because you wouldn't be able to move past that knowing you were reckless and a guy got killed... whether it was in the heat of battle or not. Let your conscious be your guide.

Sorry but I'm going to have to disagree. Tony Stewart carries an image that will make him guilty whether he really is or not. In addition, he will have to live with this the rest of his life and there will never be a day where he or the fans wont be thinking about the accident.
His only move is to leave racing period. He will never feel 100% behind the wheel if he doesn't and that alone makes it unsafe for everybody that races around him.
The only way to redeem himself and remain a part of this sport will be to get involved in the safety aspect of the sport.

I disagree that his only move is to retire. Yes he will deal with this everyday for the rest of his life in some form or fashion. But if he did nothing wrong why can't he get back on the horse and be back racing. Tony is a racer and lives to race and nothing would keep him from that if he is innocent. Police officers go back to work after shooting some one on the job, drivers of cars drive again after accidentally hit someone on the road.

If this incident happened to a normal dude on a Saturday night racing sprint cars we would have never heard this story. I witnessed a track official die at my local dirt track last year, he got hit by a guy who lost control of his car coming out of turn 2. And that driver still races. I saw the entire accident. In reality mistakes happen and life goes on whether we like it or not.

I don't think Stewarts returning to racing is going to boil down to him being innocent or guilty.....I think it will have more to do with how he thinks people will react if and when he does return. I personally don't think he is guilty but you know there will be people out there that do.
I would bet for one, Stewart at least skips the rest of this season, and two, his return(if he does return) will be after a long cool down session.
